What a New York State lease actually cares about

Upstate ice and lake-effect snow, coastal Sandy, HSTPA. Not a paste of the NYC inner page.

1

Required downstate, looser upstate

No statewide mandate. The vast majority of Manhattan, Brooklyn, Queens, Long Island, and Westchester landlords write insurance into the lease, usually a $100,000 or $300,000 liability minimum with the landlord as an additional interested party. Upstate landlords in Buffalo, Rochester, Syracuse, and Albany are somewhat less consistent. The 2019 Housing Stability and Tenant Protection Act expanded rent stabilization statewide but did not restrict insurance requirements in leases.

2

Lake-effect and ice upstate

Lake-effect snow in Buffalo, Rochester, and Syracuse drives the state’s biggest winter claim volume. Ice damming and burst pipes are the primary claim types from December through March. Upstate ice damming and pipe damage represent the single most common covered claim outside NYC.

3

Nor’easters, Sandy, flood extra

Nor’easters and hurricane remnants bring wind damage across the state and, in coastal counties, storm surge — not covered without a separate flood policy. Superstorm Sandy in 2012 remains the working benchmark for coastal underwriting. Wind is on the renters form. Surge is not.
